1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Color Analysis: PaletteMe mobile application ("App", "PaletteMe", "Service").

The App is operated by Lionwood Studio LTD ("Company", "we", "us", "our").

Please read these Terms carefully before using the App. By downloading, installing, accessing, creating an account, starting a subscription, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the App and should uninstall it from your device.

These Terms should be read together with our Privacy Policy, which explains how we collect, use, and protect personal data.

2. About Color Analysis: PaletteMe

Color Analysis: PaletteMe is an AI-powered mobile application that helps users discover personalized color palettes, analyze appearance-related color characteristics, receive styling guidance, and explore clothing color recommendations.

The App may allow you to:

  • take a selfie or upload a photo of yourself from your device;
  • complete a personalized onboarding experience;
  • receive personalized color analysis based on your appearance-related color characteristics;
  • discover undertones, seasonal color types, and contrast recommendations;
  • receive personalized color palette suggestions;
  • explore outfit color combinations and styling guidance;
  • receive recommendations on which colors may suit your appearance best;
  • scan clothing colors to understand compatibility with your palette;
  • save scan history, preferences, and personalized recommendations;
  • access premium features through a subscription.

The App is intended for personal, non-commercial use only.

3. Changes to These Terms

We may update or modify these Terms from time to time.

If we make material changes, we may notify you through the App, by email, or by other reasonable means.

Updated Terms become effective when posted unless stated otherwise.

Your continued use of the App after updated Terms become effective means that you accept the revised Terms.

4. Account Registration

To access certain features, you may need to create an account or sign in using a third-party sign-in method, such as:

  • Sign in with Apple;
  • Google Sign-In.

You agree to provide accurate, complete, and up-to-date information when creating or using your account.

You are responsible for:

  • maintaining the confidentiality of your account credentials;
  • all activity under your account;
  • notifying us if you suspect unauthorized account access.

We are not responsible for losses caused by unauthorized account access resulting from your failure to protect login credentials.

5. App Store and Google Play Terms

PaletteMe may be downloaded from the Apple App Store, Google Play, or another authorized app marketplace.

Your use of the App is also subject to the terms, rules, and policies of the marketplace where you downloaded the App.

If there is a conflict between these Terms and mandatory marketplace rules, applicable marketplace rules will apply to the extent required.

6. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App for personal, non-commercial purposes.

You may not:

  • copy, modify, distribute, sell, lease, sublicense, or commercially exploit the App;
  • reverse engineer, decompile, disassemble, or attempt to extract source code;
  • bypass subscription, payment, security, or access-control systems;
  • use the App unlawfully, fraudulently, abusively, or harmfully;
  • overload or impair our systems or third-party infrastructure;
  • use bots, scraping systems, automation tools, or similar technologies to access the App;
  • use the App or outputs to build, train, or improve competing AI systems, color analysis systems, or recommendation products.

All rights not expressly granted are reserved by Lionwood Studio LTD and its licensors.

7. Subscriptions and Premium Features

PaletteMe may offer premium functionality through paid subscriptions.

Subscriptions may be offered on a weekly, monthly, yearly, or other recurring basis depending on what is displayed in the App.

Subscription pricing, available plans, trial periods, included features, and renewal information will be shown before purchase.

By purchasing a subscription, you authorize Apple App Store, Google Play, or the applicable platform to charge you according to your selected plan.

Subscriptions renew automatically unless canceled before renewal according to marketplace rules.

8. Free Trials and Promotional Offers

We may offer free trials, promotional pricing, discounted subscriptions, or special offers at our discretion.

The terms of any trial or promotion will be displayed before activation.

Unless otherwise stated:

  • a free trial may automatically convert into a paid subscription;
  • you must cancel before the trial period ends to avoid charges;
  • eligibility for promotions may be limited;
  • we may change or discontinue promotional offers at any time.

9. Subscription Cancellation

You are responsible for managing and canceling subscriptions through the platform where the subscription was purchased.

If purchased through Apple, subscriptions may be managed through Apple Account subscription settings.

If purchased through Google Play, subscriptions may be managed through Google Play subscriptions.

Deleting the App or deleting your PaletteMe account does not automatically cancel subscriptions.

After cancellation, premium access may continue until the end of the billing cycle according to marketplace rules.

10. Refunds

Purchases and subscriptions are generally handled by the platform where they were purchased.

Refunds are subject to the refund policies of Apple App Store, Google Play, or the relevant marketplace.

We do not directly control refunds processed by Apple or Google.

Where required by applicable law, you may have additional consumer rights.

11. AI Color Analysis and Recommendations

PaletteMe uses artificial intelligence to provide color analysis, palette suggestions, clothing color compatibility recommendations, and styling-related guidance.

When you use AI-powered features, extracted appearance-related color characteristics and related recommendation inputs may be processed through third-party AI providers, including Google Gemini API via Firebase AI Logic.

Your original uploaded photo is not sent to Google Gemini API.

Only extracted color-related information and recommendation inputs required to generate App functionality may be processed.

You understand and agree that AI-generated results:

  • may not always be accurate, complete, or suitable for your preferences;
  • may vary depending on lighting, image quality, skin tone extraction, photo conditions, or other technical factors;
  • may differ from professional styling advice;
  • are generated automatically and may vary over time;
  • are intended for informational, inspiration, and personal styling purposes only.

We do not guarantee that any recommended color, outfit suggestion, or palette will produce a specific personal, social, fashion, or aesthetic result.

12. Styling, Color, and Outfit Recommendations

The App may provide:

  • clothing color recommendations;
  • outfit color combinations;
  • palette guidance;
  • styling suggestions;
  • jewelry color recommendations;
  • hair color direction suggestions;
  • outfit coordination guidance.

These recommendations are provided for general informational, inspiration, and personal styling purposes only.

They are not professional fashion, beauty, image consulting, medical, or psychological advice.

You are solely responsible for how you apply recommendations in real life.

We do not guarantee that any recommendation will suit your preferences, appearance, expectations, social outcomes, or purchasing decisions.

13. Clothing Color Scanner

The App may include functionality that allows you to scan clothing colors or upload photos of clothing items to evaluate color compatibility.

Scanner results are intended only as personalized guidance and informational suggestions.

Scanner recommendations:

  • may not always be accurate;
  • may vary depending on lighting, camera quality, material texture, or image conditions;
  • should not be treated as professional styling advice or guarantees.

We do not recommend or endorse specific brands, products, retailers, or purchases.

The App provides color-related compatibility guidance only.

14. User Photos and User Content

You may upload, select, generate, save, or otherwise use photos, preferences, onboarding information, scan history, and other content through the App ("User Content").

The App is intended for analysis of your own appearance.

You agree that:

  • photos uploaded to the App must belong to you or depict yourself;
  • you will not upload photos of other individuals without proper authorization;
  • you will not use the App to analyze another person's appearance without permission.

You retain ownership of your User Content.

By using the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to process User Content solely for purposes of:

  • operating the App;
  • providing color analysis and recommendations;
  • storing preferences and scan history;
  • providing personalized recommendations;
  • maintaining security and preventing abuse;
  • complying with legal obligations.

We do not claim ownership of your photos, color profiles, or generated recommendations.

15. User Content Responsibilities

You are solely responsible for User Content uploaded or used in the App.

You represent and warrant that:

  • you have the right to use uploaded content;
  • uploaded content complies with applicable law;
  • uploaded content does not violate third-party rights;
  • you will not upload harmful, abusive, unlawful, exploitative, hateful, or infringing material;
  • you will not upload images unrelated to personal color analysis purposes.

We may suspend or restrict access if we believe your use violates these Terms, applicable law, or third-party provider requirements.

16. Prohibited Uses

You agree not to use the App to:

  • violate applicable law;
  • infringe intellectual property, privacy, or publicity rights;
  • harass, impersonate, or harm others;
  • upload content you do not have permission to use;
  • bypass subscriptions, paywalls, limits, or security systems;
  • reverse engineer, scrape, misuse, or copy the App or outputs;
  • develop competing AI or recommendation systems;
  • interfere with App security or operations;
  • violate third-party AI provider rules or policies.

17. Third-Party Services

The App may rely on third-party services, including:

  • Google Gemini API for AI-powered color recommendations and analysis;
  • Firebase for authentication, diagnostics, analytics, cloud functionality, crash reporting, and App performance;
  • RevenueCat for subscription management and purchase validation;
  • Apple services for App Store distribution, Sign in with Apple, and in-app purchases;
  • Google services for Google Play distribution, Google Sign-In, and in-app purchases.

Your use of third-party services may be subject to their own terms and privacy policies.

We are not responsible for third-party services, platforms, or policies.

18. No Third-Party Advertising and Push Notifications

PaletteMe does not currently display third-party advertisements.

We do not currently use ad networks such as:

  • Google AdMob;
  • Meta Audience Network;
  • TikTok Ads;
  • AppLovin;
  • Unity Ads;
  • other third-party advertising services.

The App also does not currently use push notifications.

If advertising or push notifications are introduced in the future, we may update these Terms and Privacy Policy accordingly.

19. Intellectual Property

The App, including its software, algorithms, interface, design, branding, graphics, text, features, recommendations, color analysis systems, and other materials, is owned by or licensed to Lionwood Studio LTD and protected by intellectual property laws.

You may not use our name, logos, branding, design elements, proprietary systems, or intellectual property without prior written permission.

Nothing in these Terms transfers ownership rights in the App or our intellectual property to you.

Except for User Content you own, all rights, title, and interest in the App remain exclusively with Lionwood Studio LTD and its licensors.

20. Feedback

If you provide us with ideas, comments, feature suggestions, recommendations, bug reports, or feedback regarding the App ("Feedback"), you agree that we may use such Feedback without restriction or compensation.

You grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, reproduce, distribute, and incorporate Feedback into our products and services.

21. Availability and Changes to the App

We may update, modify, suspend, discontinue, or restrict access to the App or any part of it at any time.

We may:

  • add, remove, or change features;
  • modify subscription plans or pricing;
  • introduce or remove limitations;
  • update AI models, recommendation systems, or algorithms;
  • change technical requirements.

We do not guarantee that:

  • the App will always be available;
  • access will be uninterrupted or error-free;
  • AI-generated recommendations will always be accurate or consistent;
  • recommendations will remain unchanged over time.

The App may depend on:

  • internet access;
  • device compatibility;
  • third-party providers;
  • cloud services;
  • AI availability;
  • app marketplace services.

We are not responsible for interruptions caused by third-party services, technical failures, marketplaces, network issues, or device limitations.

22. Disclaimer of Warranties

To the fullest extent permitted by law, the App and all related services are provided on an “as is” and “as available” basis.

We make no warranties, representations, or guarantees that:

  • the App will meet your expectations;
  • the App will be uninterrupted, secure, or error-free;
  • AI-generated results will be accurate, complete, suitable, or consistent;
  • color recommendations will suit your preferences or personal taste;
  • styling recommendations will improve appearance, confidence, social interactions, or personal outcomes;
  • clothing scanner results will always be accurate;
  • any defects or issues will be corrected;
  • the App will be compatible with all devices, operating systems, or third-party services.

Recommendations generated by the App are subjective and informational in nature.

Color suitability, personal style, fashion preferences, and visual appearance are inherently subjective and may vary between individuals.

Your use of the App is entirely at your own risk.

23. Limitation of Liability

To the fullest extent permitted by law, Lionwood Studio LTD, its directors, employees, contractors, affiliates, partners, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

  • loss of profits;
  • loss of data;
  • loss of goodwill;
  • dissatisfaction with recommendations or results;
  • wardrobe or purchasing decisions;
  • fashion or styling dissatisfaction;
  • subscription or billing issues caused by third-party marketplaces;
  • device issues or compatibility problems;
  • interruptions caused by third-party services;
  • social, professional, emotional, or aesthetic outcomes associated with App recommendations.

We are not responsible for:

  • purchases made based on App recommendations;
  • dissatisfaction with clothing colors or styling decisions;
  • perceived inaccuracies in personal color analysis;
  • decisions made using App recommendations.

To the fullest extent permitted by law, our total liability arising out of or related to the App or these Terms will not exceed the greater of:

  • the amount paid by you for the App or subscription during the three months before the claim; or
  • GBP 50.

Nothing in these Terms excludes or limits liability where exclusion is not legally permitted.

24. Indemnification

You agree to defend, indemnify, and hold harmless Lionwood Studio LTD, its directors, employees, contractors, affiliates, licensors, and service providers from and against any claims, damages, liabilities, losses, costs, and expenses arising out of:

  • your use or misuse of the App;
  • violation of these Terms;
  • violation of applicable law;
  • your User Content;
  • infringement of third-party rights;
  • your real-life use of App recommendations or styling decisions;
  • purchases or actions taken based on App-generated recommendations.

This obligation survives termination of your use of the App.

25. Account Suspension and Termination

You may stop using the App at any time.

You may request deletion of your account through an in-App deletion option, if available, or by contacting us.

We may suspend, restrict, or terminate access to the App if:

  • you violate these Terms;
  • we suspect fraud, abuse, or unauthorized activity;
  • your activity creates legal, security, or technical risks;
  • required by law, app marketplace rules, or third-party provider policies;
  • we discontinue the App or related services.

Termination does not automatically cancel subscriptions purchased through Apple App Store or Google Play.

Upon termination, your right to use the App ends immediately.

Sections that naturally survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution, remain in effect.

26. Privacy

Your privacy is important to us.

Please review our Privacy Policy, which explains how we collect, process, use, store, and protect personal information.

By using the App, you acknowledge that your information may be handled according to our Privacy Policy.

27. Children's Use

The App is intended only for users aged 13 years or older.

By using the App, you confirm that you meet the minimum age requirement or are using the App under supervision where legally permitted.

We may suspend or terminate accounts that violate applicable minimum age requirements.

28. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, unless mandatory consumer protection laws in your country of residence require otherwise.

If a dispute arises, we encourage you to contact us first so that we can attempt to resolve the matter informally.

Where legally permitted, disputes relating to these Terms or the App will be subject to the courts of England and Wales.

If you are a consumer resident in another country, you may also have rights to bring claims under applicable consumer protection laws in your local jurisdiction.

29. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will remain fully valid and enforceable.

Any invalid provision will be interpreted or replaced in a manner that best reflects its intended purpose to the maximum extent permitted by law.

30. No Waiver

If we fail to enforce any provision of these Terms, this does not constitute a waiver of our right to enforce it later.

Any waiver must be made explicitly and in writing.

31. Assignment

You may not transfer or assign your rights or obligations under these Terms without prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, or operation of law.

32. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms displayed within the App, constitute the complete agreement between you and Lionwood Studio LTD regarding your use of PaletteMe.
