1. Introduction

These Terms and Conditions ("Terms") govern your access to and use of the Makeup Plus mobile application ("App", "Makeup Plus", "Service").

The App is operated by Lionwood Studio LTD ("Company", "we", "us", "our").

Please read these Terms carefully before using the App. By downloading, installing, accessing, creating an account, starting a subscription, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the App and should uninstall it from your device.

These Terms should be read together with our Privacy Policy, which explains how we collect, use, and protect personal data.

2. About Makeup Plus

Makeup Plus is an AI-powered mobile application that allows users to preview makeup styles on their own photos.

The App may allow you to:

  • Take a selfie or upload a photo from your device;
  • Complete a personalized onboarding experience;
  • Select makeup styles and beauty preferences;
  • Generate AI-powered makeup previews;
  • View step-by-step instructions on how to recreate selected makeup looks in real life;
  • Save or view your makeup history locally on your device;
  • Access premium features through a subscription.

The App is intended for personal, non-commercial use only.

3. Changes to These Terms

We may update or modify these Terms from time to time.

If we make material changes, we may notify you through the App, by email, or by other reasonable means.

The updated Terms will become effective when posted, unless stated otherwise.

Your continued use of the App after the updated Terms become effective means that you accept the updated Terms.

4. Account Registration

To use certain features of the App, you may need to create an account or sign in using a third-party sign-in method, such as:

  • Sign in with Apple;
  • Google Sign-In.

You agree to provide accurate, complete, and up-to-date information when creating or using your account.

You are responsible for:

  • Maintaining the confidentiality of your account credentials;
  • All activity that occurs under your account;
  • Notifying us if you suspect unauthorized access to your account.

We are not responsible for losses caused by unauthorized use of your account if such use results from your failure to protect your login credentials.

5. App Store and Google Play Terms

Makeup Plus may be downloaded from the Apple App Store, Google Play, or another authorized app marketplace.

Your use of the App is also subject to the rules, terms, and policies of the app marketplace from which you downloaded the App.

If there is a conflict between these Terms and mandatory rules of Apple, Google, or another app marketplace, the applicable marketplace rules may apply to the extent required.

6. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, and use the App for personal, non-commercial purposes.

You may not:

  • Copy, modify, distribute, sell, lease, or sublicense the App;
  • Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App;
  • Circumvent security, access control, subscription, or payment mechanisms;
  • Use the App for unlawful, harmful, fraudulent, or abusive purposes;
  • Use the App in a way that may damage, disable, overburden, or impair our systems or third-party systems;
  • Use automated systems, bots, scraping tools, or similar technologies to access or interact with the App;
  • Use the App to create, train, or improve competing AI models or services.

All rights not expressly granted to you are reserved by us and our licensors.

7. Subscriptions and Premium Features

Makeup Plus may offer premium features through paid subscriptions.

Subscriptions may be offered on a weekly, monthly, yearly, or other recurring basis, depending on the options shown in the App.

Subscription prices, available plans, trial periods, renewal terms, and included features will be displayed before purchase.

By purchasing a subscription, you authorize the applicable app marketplace, such as the Apple App Store or Google Play, to charge you according to the selected subscription plan.

Subscriptions automatically renew unless canceled before the renewal date according to the applicable marketplace rules.

8. Free Trials and Promotional Offers

We may offer free trials, discounted trials, or promotional offers at our discretion.

The terms of each trial or offer will be shown before you start it.

Unless otherwise stated:

  • A free trial may convert into a paid subscription after the trial period ends;
  • You must cancel before the end of the trial period to avoid being charged;
  • We may limit eligibility for trials or promotions;
  • We may change, suspend, or discontinue trials and promotions at any time.

9. Subscription Cancellation

You are responsible for managing and canceling your subscription through the platform where you purchased it.

If you subscribed through Apple, you can manage or cancel your subscription through your Apple Account subscription settings.

If you subscribed through Google Play, you can manage or cancel your subscription through Google Play subscriptions.

Deleting the App or deleting your Makeup Plus account does not automatically cancel your subscription.

After cancellation, you may continue to access paid features until the end of the current billing period, unless otherwise stated by the applicable app marketplace.

10. Refunds

Purchases and subscriptions are generally handled by the app marketplace where the purchase was made.

Refund requests are subject to the refund policies of the Apple App Store, Google Play, or the applicable marketplace.

We do not directly control refunds for purchases made through the Apple App Store or Google Play.

Where required by applicable law, you may have additional rights.

11. AI Makeup Generation

Makeup Plus uses artificial intelligence to generate makeup-related results based on photos and preferences selected by you.

When you use AI-powered features, your selected photo and related instructions may be transmitted to third-party AI service providers, including Google Gemini API, for processing.

You understand and agree that AI-generated results:

  • May not always be accurate, realistic, complete, or suitable for your expectations;
  • May vary depending on photo quality, lighting, face position, selected style, and other factors;
  • Are generated automatically and may not always perfectly match real-life makeup application;
  • Should be used for inspiration and entertainment purposes.

We do not guarantee that any AI-generated makeup result will look identical if recreated in real life.

12. Real-Life Makeup Instructions

The App may provide step-by-step instructions, recommendations, or guidance on how to recreate a makeup look in real life.

These instructions are provided for general informational and entertainment purposes only.

They are not professional cosmetic, dermatological, medical, or skincare advice.

You are responsible for:

  • Checking whether any makeup product is suitable for your skin;
  • Reviewing product ingredients and warnings;
  • Avoiding products that may cause irritation or allergic reactions;
  • Consulting a qualified professional if you have skin conditions, allergies, or health concerns.

We are not responsible for any skin reaction, allergy, injury, dissatisfaction, or other result caused by applying makeup or using cosmetic products based on App-generated instructions.

13. User Photos and User Content

You may upload, select, generate, save, or otherwise use photos, images, prompts, preferences, and other content through the App ("User Content").

You retain ownership of your User Content.

By using the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to process your User Content solely for the purpose of:

  • Operating the App;
  • Providing the requested AI makeup generation features;
  • Displaying generated results to you;
  • Providing related instructions and functionality;
  • Maintaining security, preventing abuse, and complying with legal obligations.

This license ends when the processing is complete, except where limited retention is necessary for security, legal, technical, or operational reasons as described in our Privacy Policy.

We do not claim ownership of your photos or generated results.

14. User Content Responsibilities

You are solely responsible for the User Content you upload, select, or use in the App.

You represent and warrant that:

  • You own or have the necessary rights to use the photo or content;
  • Your use of the content does not violate any third-party rights;
  • Your content does not violate applicable laws;
  • You will not upload photos of other people without appropriate permission;
  • You will not upload unlawful, abusive, harmful, sexually explicit, exploitative, hateful, or infringing content.

We may restrict, suspend, or terminate access to the App if we believe your use of User Content violates these Terms, applicable law, or third-party service provider rules.

15. Prohibited Uses

You agree not to use the App to:

  • Violate any applicable law or regulation;
  • Infringe intellectual property, privacy, publicity, or other rights;
  • Harass, abuse, defame, impersonate, or harm others;
  • Generate deceptive, misleading, or harmful content;
  • Upload content you do not have the right to use;
  • Attempt to bypass paywalls, subscriptions, usage limits, or security controls;
  • Reverse engineer, scrape, copy, or misuse the App or its outputs;
  • Use the App to develop competing products or AI systems;
  • Interfere with the operation or security of the App;
  • Use the App in any way that violates third-party AI provider terms or policies.

16. Third-Party Services

The App may rely on third-party services, including but not limited to:

  • Google Gemini API for AI-powered image processing;
  • Firebase for authentication, analytics, diagnostics, crash reporting, and performance monitoring;
  • RevenueCat for subscription management and purchase validation;
  • Apple services for App Store distribution, Sign in with Apple, and in-app purchases;
  • Google services for Google Play distribution, Google Sign-In, and in-app purchases.

Your use of these services may be subject to their own terms, policies, and privacy practices.

We are not responsible for third-party services, websites, platforms, or policies.

17. No Third-Party Advertising

Makeup Plus does not currently show third-party advertisements.

We do not currently use advertising networks such as:

  • Google AdMob;
  • Meta Audience Network;
  • TikTok Ads;
  • AppLovin;
  • Unity Ads;
  • Other third-party ad networks.

If we add advertising or ad-related features in the future, we may update these Terms and our Privacy Policy.

18. Push Notifications

The App does not currently use push notifications.

In the future, we may add push notifications for purposes such as:

  • App updates;
  • Feature announcements;
  • Subscription reminders;
  • Personalized beauty reminders;
  • Saved look reminders.

If push notifications are added, you will be able to manage notification permissions through your device settings.

19. Intellectual Property

The App, including its software, design, interface, graphics, branding, logos, text, features, functionality, and other materials, is owned by or licensed to Lionwood Studio LTD and is protected by intellectual property laws.

You may not use our name, logo, branding, design elements, or other intellectual property without our prior written permission.

Nothing in these Terms transfers any ownership rights in the App or our intellectual property to you.

20. Feedback

If you provide us with ideas, suggestions, comments, or feedback about the App ("Feedback"), you agree that we may use such Feedback without restriction or compensation to you.

You grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, reproduce, distribute, and incorporate Feedback into our products and services.

21. Availability and Changes to the App

We may update, modify, suspend, or discontinue the App or any part of it at any time.

We may add, remove, or change features, subscription plans, pricing, limits, or technical requirements.

We do not guarantee that the App will always be available, uninterrupted, secure, or error-free.

The App may depend on internet access, third-party services, device compatibility, app marketplace availability, and AI provider availability.

We are not responsible for interruptions or limitations caused by third-party services, technical issues, app stores, networks, or devices.

22. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the App and all related services are provided on an "as is" and "as available" basis.

We make no warranties, representations, or guarantees that:

  • The App will meet your expectations;
  • The App will be uninterrupted, secure, or error-free;
  • AI-generated results will be accurate, realistic, complete, or suitable for your needs;
  • Makeup instructions will produce the same result in real life;
  • Any defects or errors will be corrected;
  • The App will be compatible with all devices, operating systems, or third-party services.

Your use of the App is at your own risk.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Lionwood Studio LTD, its directors, employees, contractors, partners, service providers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to:

  • Loss of profits;
  • Loss of data;
  • Loss of goodwill;
  • Loss of business opportunity;
  • Device issues;
  • Subscription or payment issues caused by third-party platforms;
  • Dissatisfaction with AI-generated results;
  • Any consequences of applying makeup or using cosmetic products in real life.

To the fullest extent permitted by applicable law, our total liability arising out of or relating to the App or these Terms will not exceed the greater of:

  • The amount you paid for the App or subscription during the three months before the claim; or
  • GBP 50.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law.

24. Indemnification

You agree to defend, indemnify, and hold harmless Lionwood Studio LTD, its directors, employees, contractors, service providers, and affiliates from and against any claims, damages, liabilities, losses, costs, and expenses arising from:

  • Your use or misuse of the App;
  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your User Content;
  • Your infringement of third-party rights;
  • Your use of AI-generated results outside the App;
  • Your real-life use of makeup instructions or recommendations.

This obligation survives termination of these Terms and your use of the App.

25. Account Suspension and Termination

You may stop using the App at any time.

You may request account deletion by contacting us or by using an in-app deletion option, if available.

We may suspend, restrict, or terminate your access to the App if:

  • You violate these Terms;
  • We suspect fraud, abuse, or unauthorized activity;
  • Your use creates legal, security, or technical risk;
  • Required by law, app marketplace rules, or third-party provider policies;
  • We discontinue the App or relevant features.

Termination of your account does not automatically cancel active subscriptions purchased through the Apple App Store or Google Play.

Upon termination, your right to use the App ends immediately.

Sections that by their nature should survive termination will remain in effect, including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution.

26. Privacy

Your privacy is important to us.

Please review our Privacy Policy, which explains how we collect, use, share, and protect personal data.

By using the App, you acknowledge that your data will be handled according to our Privacy Policy.

27. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales, unless mandatory consumer protection laws in your country of residence require otherwise.

If a dispute arises, we encourage you to contact us first so we can try to resolve the issue informally.

Where legally permitted, disputes relating to these Terms or the App will be subject to the courts of England and Wales.

If you are a consumer resident in another country, you may also have the right to bring claims in your local courts under mandatory consumer protection laws.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be interpreted or replaced in a way that best achieves its intended purpose to the extent permitted by law.

29. No Waiver

If we do not enforce any provision of these Terms, this does not mean that we waive our right to enforce that provision in the future.

Any waiver must be made in writing to be effective.

30. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.

31. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms displayed in the App, constitute the entire agreement between you and Lionwood Studio LTD regarding your use of Makeup Plus.
